Terms of Service

Every client that commissions me must adhere to these Terms of Service. If you cannot agree to the TOS then please find another artist. By commissioning me in any way, you are agreeing to these terms.

General Terms

Please write what you wish to commission in a clear and concise manner so as to avoid any miscommunication.

References are important and necessary for certain commissions. It is your job to provide the proper references. I am not liable for any miscommunications if proper references are not provided. 

Provide the necessary dimensions/ sizes you would like your commission to be. If you do not know the right sizes for what you want, please do your own research. 

Any ill behavior will not be tolerated and will result in you being blacklisted.

I retain the right to reject commissions as I see fit or if any of the terms are broken.

Payment

All commissions must be paid for upfront. 

Until the commission has been paid for, your spot on my list of commissions will not be guaranteed. You will be added to a Pending list. As such, I advise you to pay as soon as possible. Audience has nothing to do with pricing so do not try to commission me using your audience as leverage.

After the commission has been accepted, there will be no free change of the main idea of the commission (such as adding more characters). If you insist on changing or adding to the commission, I hold the right to charge a fee appropriate to that of the change.

 Upon receiving the full payment, you will be placed on my commissions list and informed of when I start sketching your art. Once the sketch is done, receiving your input is vital for this part of the process as this will be your opportunity to ask me for changes. I will not redo the sketch more than a maximum of three times. It is critical that you relay your intent for your commission for this reason.  

Refund Policy

There will be no refunds after I’ve started the artwork unless I fall sick or am unable to complete the commission because of extenuating circumstances. But I reserve the right to cancel and refund any commission at my discretion. If money has not yet been sent however, the commissioner has the right to cancel the commission. Please just let me know if you do so.

Works in Progress

Works in progress will sometimes be provided for longer and more complex projects. I advise those that commission me to respond promptly to these so that any necessary decisions can be made. If a customer does not respond to a WIP message within an appropriate time frame (or earlier depending on due dates), I reserve the right to make decisions for the art piece based on my own judgment so I can move onto other things.

Process

The commissioner will be sent an invoice from my PayPal via email depending on the price of their commission.

Upon receiving payment, the sketching stage will begin. 

The sketching stage will be the commissioner's only opportunity to make changes. However, I may also update them with a work in progress to ask about certain aspects of the artwork. Even so, the only guaranteed update is during the sketch stage.

Once the commission has been completed, the commissioner will receive it after providing their preferred email or through discord. If the commissioner would like to receive it in a different manner, please mention so. All digital works are sent digitally with no need for shipping.

Customer Satisfaction

I want my customers to get the best service and artwork they can possibly get from me and I would love to establish good relations with everyone. I hope to create a nice experience when commissioned. 

After a commission is finished, no changes will be made to it. If the customer still wants to make changes, I will have to charge a sizable fee regardless of whether or not they are a returning customer. However, this is sometimes not possible due to file corruption or loss of the file completely

. This is why references are critical in the process of commissioning any artist, not just me. Examples include character designs, human or creature poses, environments, etc.

Copyright / Usage Policy

As the artist, I hold every right to the produced artwork, not the commissioner. 

Therefore, I am allowed to use the artwork in any which way I prefer.

I also reserve the right to cancel your ability to use the commission under extenuating circumstances such actions falling under questionable ethics or criminal activity.

The customer is allowed to buy the rights to the artwork from me and 300% of the original cost.

Merchandise will function differently and commercial licenses for this can be negotiated. A copy of the agreed upon commercial licenses will be sent via email so that both parties have it to refer back to. 

When commissioning me, you are buying the rights to use the artwork, such as emotes, backgrounds, graphics, and logos, for discord, youtube, and twitch or any other requested format.

The commissioner is allowed to use the copyrighted artwork for personal use only unless agreed upon otherwise. Print the art for personal use. Selling prints without a commercial license is not allowed and is copyright infringement. The commissioner is allowed to use the artwork to promote themselves with proper credit given to the artist, myself. 

If you break the copyright infringement in any way, every right you had to the drawing will be retracted.

Your Rights

You can repost, reshare, and print for personal use.

You can use it as a background, an icon, or an avatar for socials.

You can use it for youtube and twitch (emotes, backgrounds, etc).

The following is considered copyright infringement

Reproducing/ using the copyrighted artwork commercially. (Meaning making money off of it in any way.)

Taking credit for the creation of the artwork.

Removing and watermarks/ signatures.

Altering the artwork in any way without my, the artist's, consent.

Commercial License

A purchase of commercial rights to the artwork will always be 300% of the original price.

With commercial rights you are allowed to make any sort of merch with the artwork such as books, covers, props, change it to your own liking and promote your own brand in any way with it. However, credit is still required for usage of the artwork. Alterations to the artwork must still go by me, the artist, first.

Private Commissions

Private commissions always come with a 50% fee. A private commission restricts me from promotionally using the artwork and talking about it. It is akin to a Non Disclosure Agreement. This is usually an option for those who wish to keep big projects secret.

 

For smaller works such as birthday surprises, gifts, etc, just let me know ahead of time so that I don’t share it in streams or on social media.

Emote Bundles

Emote bundles are premade emotes in which I still own but the customer has bought the rights to use. Reproducing/ using the copyrighted artwork commercially, (meaning making money off it in any way), taking credit for the creation of the artwork, removing and watermarks/ signatures, and altering the artwork in any way without my, the artist's, consent are not allowed and will force me to take legal action.
